Is CBD legal?

Yes. Hemp derived CBD products such as ours are legal in the United States.

1970 CONTROLLED SUBSTANCES ACT

The Controlled Substances Act (CSA) made cannabis plants illegal, as it defined all cannabis as "marijuana". The CSA made exclusion for "mature stalks" of the cannabis plant and products such as fiber, oil and cake made from hemp seed, and sterilized hemp seeds.

2004 HIA v. DEA

On February 6, 2004 the Hemp Industry Association won it's lawsuit against the Drug Enforcement Administration. The DEA had been seeking to prevent purchase and sale of hemp products, legal under 21 U.S.C. § 802(16) . The court decided against the DEA, concluding that: "they cannot regulate naturally-occurring THC not contained within or derived from marijuana-i.e., non-psychoactive hemp products-because non-psychoactive hemp is not included in Schedule I. The DEA has no authority to regulate drugs that are not scheduled, and it has not followed procedures required to schedule a substance."

As of 2017, this ruling has not been challenged. The definition of hemp was extremely limited at this time, but that changed ten years later.

 2014 AGRICULTURAL ACT

In a milestone for the re-emergence of the American hemp industry, the Agricultural Act of 2014 re-defined industrial hemp: "The term ‘‘industrial hemp’’ means the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a [THC] concentration of not more than 0.3 percent on a dry weight basis." This Act, also known as the Farm Bill, also opened the doors up for states to allow for hemp farming.

2016 APPROPRIATIONS ACT

Sec. 763 protected "the transportation, processing, sale, or use of industrial hemp that is grown or cultivated in accordance with subsection section 7606 of the Agricultural Act of 2014."

What is CBD and how does it work?

CBD is an abbreviation for cannabidiol, the most prominent naturally occurring cannabinoid component found in hemp, and comprises up to 40% of the hemp plant.

According to the US Government, cannabidiol is “…devoid of psychoactive effect.” After THC (9-tetrahydrocannabinol), CBD is by far the most studied natural cannabinoid. Additionally, CBD is increasingly the subject of advanced medical research and may be the single most important cannabinoid ever discovered.

What's this entourage effect I keep hearing about?

The “entourage effect” is a term scientists use to describe the interaction between various compounds in cannabis. It is widely believed that when consumed together, certain cannabinoids and other compounds have more beneficial effect than when consumed independently.

What are terpenes?

Terpenes are naturally occurring compounds produced by a variety of plants, and even some insects. Terpenes and terpenoids are responsible for the distinctive scents of pine trees, lavender, citrus fruits and all varieties of cannabis. The terpene profiles of the various strains of cannabis are incredibly diverse and influence the flavor, scent and overall character of each strain.

Is CBD and THC the same thing?

No, they are different compounds. CBD and THC are both cannabinoids, but THC produces psychoactive effects causing a drugged symptom commonly known as a “high”. Although all CBD extractions will contain some THC, our CBD hemp plants are selected, cultivated and processed to minimize THC content to trace amounts within regulatory limitations and are devoid of psychoactive effects.

Is this medical cannabis and do I need a doctor’s recommendation?

Because our CBD is derived from hemp and is non-psychoactive, and contains no thc a doctor’s recommendation is not necessary,

Do we lab test our products?

All FreeofTHC Products are regularly tested in independent laboratories to ensure 99+% in purity. Lab reports available on request.

Can I pass a drug test using with your products?

YES. Fortunately, the urine drug screen for THC-COOH is known to have very little cross-reactivity to other cannabinoids that are not psychoactive, such as CBD (cannabidiol), CBG (cannabigerol), CBN (cannabinol), and others. This is good news for “normal” consumers of CBD/hemp oil.
That said, individuals using unusually large doses of a cannabinoid-rich hemp oil product (above 1000-2000 mg of hemp oil daily) could theoretically test positive during the initial urinary screen. Although very rare, the urine screen in these cases would likely represent a “false positive” due to other non-THC metabolites or compounds, which may cross-react with the immunoassay. When this is the case, the confirmatory GC/MS test would be negative, since CBD and other cannabinoids will not be detected by the more accurate (and specific) GC/MS screen.

Why do Cannabinoid Levels Vary?

The percentage of both CBD and THC varies depending on the type of plant. CBD rich hemp has virtually no trace of THC, while marijuana grown for recreational use tends to have much higher levels of THC and lower degrees of CBD. Selectively bred hemp contains the highest amount of CBD.

How is hemp different from marijuana? Why grow hemp and not marijuana for CBD?

Both are Cannabis sativa plants, however, the level of THC and other compounds differ. Marijuana has been bred to achieve high levels of THC for its psychoactive effects. Hemp grown for medical use is cultivated and processed to extract CBD and other cannabinoid oils with the lowest possible level of THC so there are no psychoactive effects from the use of the plant.

Is CBD from hemp as good as CBD from marijuana?
The short answer is yes. CBD is CBD, whether from marijuana or hemp. Most marijuana has a very low cannabidiol profile, so most of the time hemp would be much more preferable regarding CBD potency because it naturally has such a high amount of it.
There are however certain strains of marijuana that are being grown with a very high CBD content, but this is presently very rare. And the few growers that do have high CBD marijuana strains are struggling to provide for all the people in need. Our CBD percentage from hemp is still comparable to these high CBD marijuana strains, and will soon actually surpass them. So, industrial hemp is not just an ideal alternative to marijuana, but is most of the time the preferable choice.
*The cannabis strain Charolotte's Web is now considered a variety of hemp, which flies in the face of a common misconception that marijuana is a better source of CBD than hemp, being that Charlotte's Web gave CBD the very popularity it is now experiencing. THC and CBD tend to balance each other out, ratio-wise, in cannabis plants, so if enough breeding attention is given to increasing CBD levels, the THC levels will naturally fall and eventually you will have a harvest that will be under .3% THC on a dry-weight basis, making it fall within the definition of Industrial Hemp. Hemp is truly a wonderful source of cannabidiol (CBD), as is obvious from our quality and the feedback we've received from thousands of different people.

What is the mixing ratio of your terpenes?

Our terpenes are highly concentrated so for this reason we recommend starting at three percent (3%) or for best results, starting at 1-2 drops per gram, and adjust accordinglly, At the end of the day, it’s all about personal preference; using our guidelines referenced above should put you on track.

How do I use CBD crystal isolate?

We recommend that CBD be dabbed, cooked with, vaporized, orally ingested, or combined and smoked with dry herbs of any sort.
